Terms & Conditions

By registering for, attending, or otherwise participating in any program offered by Every Child Valued (“ECV,” “we,” “us,” or “our”), including year-round, after-school, summer, enrichment, virtual, or field trip activities (collectively, the “Program(s)”), you (the participant or parent/guardian) agree to abide by these Terms & Conditions. If you do not agree, you may not participate.


ECV reserves the right to modify these Terms & Conditions at any time (for example, to reflect changes in law or program structure). Any such changes will be posted on our website or communicated directly to participants, and your continued participation constitutes acceptance of the updated terms.


2. Eligibility & Enrollment

  • Only participants who satisfy program eligibility requirements (age, grade, residency, etc.) may enroll.

  • Enrollment is confirmed upon receiving a completed registration form, signed Participant Agreement (including waiver, medical release, and policies), and payment of any required fees (if applicable).

  • ECV may refuse or cancel enrollment at its discretion (e.g. capacity, safety concerns, incomplete paperwork).

  • Cancellation by participant must be made in writing and is subject to any refund policies published for the specific Program.


3. Assumption of Risk & Release / Waiver

As a condition of participation, the participant (or parent/guardian for minors) acknowledges, understands, and accepts the inherent risks associated with participation, including but not limited to accidents, injuries, illness (including communicable diseases), property damage, or other harm.


By signing this agreement, you (and your heirs, successors, guardians) release, waive, and hold harmless ECV, its officers, directors, employees, volunteers, agents, contractors, and affiliates (collectively “Releasees”) from liability for any injury, loss, or damage arising out of or relating to participation in the Program, to the fullest extent permitted by law. This includes claims arising from negligence, except in cases of gross negligence or intentional misconduct (where prohibited by law).


You also agree to indemnify and defend the Releasees from any claims or actions brought by others (including third parties) arising from your (or your child’s) actions, omissions, or participation in the Program.


4. Medical Treatment, Health & Insurance

  • You warrant that your child is physically fit to participate and that you have disclosed any relevant medical, behavioral, or developmental conditions (including allergies, medications, accommodations).

  • In the event of injury or illness, ECV is authorized to seek emergency medical care (first aid, transport, treatment) as deemed appropriate. You assume financial responsibility for all medical expenses incurred.

  • ECV does not guarantee coverage of health or accident insurance — participants are encouraged (or required) to maintain their own coverage.


5. Program Conduct, Rules & Safety

  • Participants must follow all program rules, staff instructions, safety guidelines, and direction from ECV personnel.

  • ECV may dismiss or suspend participants for misconduct, safety threats, or failure to comply with policies (without refund).

  • ECV reserves the right to cancel, postpone, or modify program sessions (or parts thereof) due to weather, emergencies, low enrollment, public health orders, or other causes beyond its control.


6. Transportation & Field Trips

  • For any transportation (bus, van, carpool) provided or arranged by the Program, liability is limited as permitted by law.

  • Participants must board and disembark only at designated locations unless otherwise authorized in writing.

  • You must notify ECV in advance of specific pickup/dropoff constraints or custody orders; ECV will rely on the designation in the registration forms and may require legal documentation to enforce custodial limitations.


7. Virtual / Online Components

  • If programs include virtual or web-based instruction, you agree that supervision of minors may fall to the parent/guardian during remote sessions.

  • Participants must abide by acceptable use of technology, internet safety, and any remote communication policies set by ECV.

  • ECV is not liable for data breaches, loss of connectivity, hardware/software malfunctions, or misuse of technology by participants beyond ECV’s control.


8. Media / Photography / Publicity

You grant ECV the right to photograph, record, or video participants during Program activities and to use those images or recordings (with or without names) in promotional and informational materials (print, digital, social media, website) in perpetuity, unless you provide written notice prior to start of the Program refusing such use.


9. Privacy & Data

  • Personal information collected during registration and participation will be handled in accordance with ECV’s Privacy Policy.

  • ECV may share contact or demographic data with partners, grantmakers, or collaborators, consistent with the stated purposes and policies.

  • ECV takes reasonable measures to protect data security but is not liable for unauthorized access or breaches beyond our control.


10. Fees, Payments & Refund Policy

  • Program fees (if any) and payment schedules will be set per program and communicated at registration.

  • Late payments may incur fees or suspension of enrollment privileges.

  • Refunds, if any, follow the specific policy for the given program (e.g. full refund if cancellation before start date minus administrative fee, partial credit, or no refund after a cutoff).

  • Returned checks or failed payments may incur additional charges and may jeopardize ongoing enrollment.


11. Limitation of Liability & Disclaimers

  • To the maximum extent permitted by law, ECV’s aggregate liability to any participant for any cause is limited to the fees paid for the Program in question.

  • ECV disclaims all warranties (express or implied) to the extent permitted by law, including fitness for a particular purpose, non-infringement, or guarantee of results.


12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

  • Any dispute arising under or relating to these Terms or participation must be brought solely in a New Jersey state or federal court located within Mercer County (or another county as ECV may specify), and participants submit to that jurisdiction.

  • If any part of these Terms is held invalid or unenforceable by a court, the remainder of the Terms will remain in effect (severability).


13. Entire Agreement

These Terms & Conditions (and any additional written program agreements, waivers, or policies you sign) represent the entire agreement between you and ECV regarding the Program(s). Any modification must be in writing and signed by both you and an authorized ECV representative.
